Governor Murphy Increases Capacity Limits on Restaurants and Businesses

Legislative Updates General Business
On February 3, Governor Murphy announced he will be signing an Executive Order increasing capacity limits and making other changes for restaurants, casinos, gyms, personal care businesses, and amusement and recreation facilities. The Order will go into effect at 6 a.m. this Friday, which will allow restaurants and bars to remain open for Super Bowl LV this weekend – something New Jersey restaurants and bar have been requesting over recent weeks.

The Order will increase current indoor capacity limits from the current 25 percent to 35 percent. It will also allow restaurants to stay open past 10 p.m., permitting individual municipalities to enact their own restrictions regarding hours of operation. The ban on indoor bar seating will remain in place.

Additionally, the Order will allow indoor religious ceremonies or services, wedding ceremonies, political activities, and memorial services or funerals to be at 35 percent of capacity of the room in which they take place, however they will be capped at no more than 150 total individuals. Performance venues may also expand audiences to 35 percent of their listed capacity, up to a maximum of 150 individuals.

The text of the Executive Order, once it becomes available, can be viewed here.
