Connell Foley LLP, a full-service commercial law firm with a dedicated construction law practice,  has teamed with BCA Insurance Group, a property/casualty insurance and surety company serving the construction industry, for a complimentary two-part webinar series to help contractors navigate the realities of doing business amid and after a pandemic. The programs will address current issues, such as vaccination concerns, and risks and liabilities that didn’t exist in prior times, as well as the long-term impacts that COVID-19 is expected to have on the construction industry. The webinar series, Protecting Your Construction Company in the Age of COVID,” will take place on April 14 and May 12, 2021.


Featuring industry practitioners from both Connell Foley and BCA Insurance, and moderated by TD Bank, the webinars will focus on complying with the law while minimizing exposure, keeping projects and employees humming, maintaining profits at a time when many business owners find themselves at sea, and how to apply lessons learned going forward. The goal is to answer questions that are keeping construction business professionals awake at night.


The upcoming webinars are:

Part 1:  “COVID Vaccines the Law, and Your Coverage

April 14, 2021, 1 PM - 2 PM (EST)

Presenters: Michael Shadiack, chair, Labor and Employment Group, Connell Foley LLP; Lawrence D. Cohen, executive vice president, BCA Insurance; Moderator: Rob Curley, market president, South Jersey, TD Bank. This webinar will address the concerns construction businesses have right now, including:

  • Can employers mandate employees receive a COVID vaccine? What options exist other than mandating vaccination?
  • Can employers require employees to quarantine after out-of-state travel?
  • What policies should employers implement to reduce the business risks associated with COVID-19?
  • How and when should employers report COVID cases to their workers comp carrier? Can you get sued for “giving COVID” to other contractors, and are you covered for that?

 

Part 2: “Looking Forward: COVID’s Impact on Contracts and Risk

May 12, 2021, 1 PM – 2 PM (EST)

This webinar will examine the future impact the COVID pandemic is expected to have on the construction industry, including:

  • How is COVID expected to change construction contracts going forward?
  • What contract clauses are going to be most important and what can contractors do to try to minimize their risks?
  • How will contractual changes impact other areas, including performance bonds?
  • What is changing regarding insurance in 2021 and beyond?
  • Will COVID drive up my premiums in 2022?


Presenter Biographies:

Michael Shadiack, Chair, Labor and Employment Group, Connell Foley LLP

Michael Shadiack is chair of Connell Foley’s Labor and Employment Group. Representing a broad spectrum of employers and management personnel in the private and public sectors, Shadiack provides litigation defense and dispute resolution, as well as preventive compliance counseling and training. His diverse client base includes: privately owned and operated businesses; international, national and regional corporations; nonprofit organizations; higher education institutions; municipalities; public agencies; multi-employer trade associations; and commercial employment practice liability insurance firms. Shadiack partners with businesses to provide guidance and solutions on the many issues and challenges facing employers, offering practical, comprehensive and preventive recommendations on substantive personnel and benefit issues to ensure compliance with current statutory and common law requirements. He is a featured presenter nationally and regionally, and frequently authors articles on developing employment law issues.

 

Mark Fleder, Senior Partner, Construction Law Group, Connell Foley LLP

Mark Fleder brings decades of construction litigation experience to bear in representing general contractors, specialty sub-contractors, suppliers, design professionals and public and private owners in the full range of construction disputes. Through his extensive relationships with architects, engineers, accountants and other experts, Fleder has developed a comprehensive knowledge of the complex technical details involved in disputes over defective construction, warranties and design flaws, as well as payment issues pertaining to claims for construction defects, extras, delays, damages and back charges, bid protests and multi-party settlements. Fleder also provides counsel in matters involving complicated insurance and defense problems stemming from construction projects such as power plants, prisons, casinos and hospitals. He is experienced in all aspects of litigation, from trials to appeals, arbitrations and mediations. For more than 10 years, he was a faculty member/speaker for the National Practicing Law Institute’s Construction Law Program on the subject of delay claims and resulting damages. He routinely speaks as an expert on construction-related topics to various groups including contractors, owners, designers, insurers, contractor associations and accountants.


Lawrence D. Cohen, Executive Vice President and Partner, BCA Insurance Group 

Lawrence Cohen has been executive vice president and a partner at BCA Insurance Group since 2012. An expert insurance services executive, Cohen has delivered well-designed and thoughtful solutions for his clients worldwide for the past 30 years. He navigates the intricacies of complex terms and policies and provides risk management advice that helps his clients reduce costs, while offering effective coverage and services. As a partner in the BCA Insurance Group, he manages the day to day operations of the firm as well as working to attract and maintain middle market clients. Cohen has a proven track record of scaling up organizations. Since joining BCA, the firm has more than doubled their client base. Rob Curley, Market President, South Jersey, TD Bank

An experienced market leader and strong finance professional with a history of working in the banking industry, Rob Curley is skilled in commercial and small business analytical skills and deal structuring, retail banking, team building, and community engagement/fundraising.
